Buy American - Approved Products
Recipients of the New Jersey’s Clean Energy Program (NJCEP) ARRA funds must comply with the Buy American clause unless a specific exemption applies.
The Board of Public Utilities (BPU) is the New Jersey State Energy Office (SEO) tasked by the US Department of Energy to oversee compliance issues associated with energy-related ARRA projects. As part of this supervisory role, the BPU will review compliance to the “Buy American” initiative for these projects occurring within the state of New Jersey. Below is a list of products, categorized by measure, that have been conditionally approved by the BPU for use in ARRA-funded projects. This list will be augmented as more items are submitted for consideration; it is not comprehensive and may not list all items that qualify as Buy American compliant. If any part of a public project receives ARRA funds, the Buy American initiative applies to the entire project unless the ARRA funds are only used for certain portions of the project and those portions are separated by scope and cost within the contract. The Buy American terms are required to be part of every request for proposal or solicitation of bids and all contracts.
